Terms of Use

Terms of Use for the RIDE OUT App

1. General
1.1. The following Terms of Use apply as General Terms and Conditions for the use of the RIDE OUT App (hereinafter "App"), which is offered by makeDot UG (limited liability), Windröschengasse 10, 49401 Damme (hereinafter "makeDot UG").
1.2. The current version of these Terms of Use can be accessed via the page www.ride-out.app/pages/nutzungsbedingungen and can also be viewed via the App menu (Settings → Legal Notice). makeDot UG reserves the right to adjust these Terms of Use as needed. In such a case, users will be informed of the changes, and the updated Terms of Use will be made available.
1.3. Users may object to such changes by sending an email to support@ride-out.de within 14 days. If no objection is made, the changes will automatically come into effect after the period expires. If a user objects, they may no longer use the App after the period expires.
1.4. If users have questions or complaints regarding the App, they can contact makeDot UG at the address mentioned in 1.1 or by email at support@ride-out.de.

2. Nature and Scope of RIDE OUT Services
2.1. The App is available for Android and iOS in the respective App Store and can be downloaded there free of charge. Mobile service provider costs for data transmission may apply.
2.2. The use of the App is free of charge, but requires registration and the creation of a profile.
2.3. makeDot UG strives to offer the services without restrictions. However, due to maintenance work, technical malfunctions, organizational limitations, or force majeure, it may happen that individual services are temporarily unavailable or that functionality is restricted.
2.4. The App offers the following services:
2.4.1. RIDE OUT is a service that allows users to set a meeting point ("RideOut") and share it with friends or all other users to go on motorcycle tours together. The RideOuts are displayed on a map.
2.4.2. On this map, locations of interest for motorcyclists ("Hotspots") can also be displayed (e.g., gas stations, rest areas, workshops). Users can add their own hotspots. In order for these to be seen by other users, they are verified and, if necessary, adjusted by the RIDE OUT team. Additional information (e.g., opening hours) can be viewed for some locations.
2.4.3. RIDE OUT contains a news overview where it is possible to upload images and texts that can be viewed by all other users.
2.4.4. Users can send private messages to other users.
2.4.5. Users can generate an invitation link or QR code that leads to the App Store or their own profile and share it via various channels (e.g., WhatsApp, social networks).
2.5. For the full use of all services, various permissions are required, including access to location data. If these are not granted, individual services will function only to a limited extent or not at all.
2.6. Users have the option to purchase various designs to customize the marker appearance when creating a RideOut.

3. Rights to Content
3.1. The digital content of the App – in particular the RIDE OUT logo, texts, graphics, photos, sounds, and other published data – is protected by copyright, trademark law, or other intellectual property rights and belongs to makeDot UG.
3.2. The purchase of marker designs (see 2.6) merely entitles the user to use them within the scope of the provided functionality. Ownership rights remain with makeDot UG. makeDot UG may revoke, change, or remove designs from the App. In the event of violations of the Terms of Use, no refund will be provided.

4. Usage Rights
4.1. Users may use the App, including the digital content contained therein, for private purposes. This right is revocable, non-transferable, free of charge, and non-sublicensable.
4.2. For commercial use, additional conditions apply, which will be pointed out to the user separately. In the event of contradictions, the commercial terms take precedence.
4.3. If a user violates these Terms of Use, the usage right expires. makeDot UG may block access to the App without prior notice.
4.4. In addition to the expiration of usage rights, legal consequences may arise, e.g., claims for injunctive relief or damages.

5. Obligations of the User
5.1. The user agrees to use the App only within the scope of these terms.
5.2. The user agrees not to post or forward any illegal, racist, insulting, defamatory, or pornographic content and not to infringe upon the rights of third parties.
5.3. The App may be used exclusively for private purposes. Commercial use only by prior agreement.
5.4. The user agrees not to harass other users via the communication channels and not to disrupt the operation of the services.
5.5. makeDot UG reserves the right to delete platform-harmful behavior – especially excessively vulgar, insulting, politicized, racist, homophobic, or otherwise discriminatory content – without prior notice or to take other appropriate measures against the user.

6. User-Generated Content
6.1. For content that users post (including RideOuts, posts, hotspots), makeDot UG grants itself the right to forward this to other users.
6.2. The user warrants that they possess all necessary rights to their content. They indemnify makeDot UG against claims by third parties.
6.3. makeDot UG assumes no liability for the completeness or accuracy of user-generated content.

7. Child Protection Policy
Content or behavior that endangers children is prohibited. In case of suspicion, the reporting function can be used. The RIDE OUT team will delete such content immediately and reserves the right to take legal action.

8. Liability, Security, and Personal Responsibility
8.1. Part of the services contains sensitive data. A created RideOut may contain location and time. Personal safety is the responsibility of the users. makeDot UG assumes no liability for ensuring that users only create a RideOut in a safe environment or do not share harmful information.
8.2. makeDot UG is liable without limitation for damages to life, limb, or health in cases of intentional or grossly negligent breach of duty as well as for mandatory statutory provisions.
8.3. Unless otherwise regulated, any further liability of makeDot UG is excluded.

9. Data Protection
makeDot UG complies with relevant data protection regulations. The privacy policy is available at www.ride-out.app/pages/datenschutzerklaerung.

10. Final Provisions
Should individual provisions of these terms be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. Invalid regulations shall be considered replaced by valid provisions that come closest to the economic purpose.

Protection Against Sexual Abuse and Sexual Exploitation of Children

1. Scope and Objective

These standards apply to all offers and services of Ride Out as well as to all registered users. The goal is to consistently protect children and minors from sexual abuse and sexual exploitation and to ensure a safe framework for the community.

2. Legal Basis

These standards are based on the UN Convention on the Rights of the Child (UNCRC) including the Optional Protocol on the Sale of Children, Child Prostitution and Child Pornography, on national laws for the protection of children and young people (in particular §§ 176 et seq. of the German Criminal Code), as well as on the guidelines of the National Center for Missing & Exploited Children (NCMEC).

3. Preventive Measures

Ride Out conducts an automatic profile check in which profiles are scanned fully automatically for possible policy violations, and conspicuous profiles are immediately flagged and sent for accelerated manual review. Additionally, there is a binding Code of Conduct that defines clear rules for interacting with one another and for the protection of minors and provides for immediate exclusion from the community in case of violations.

4. Detection Procedures

The automatic profile check serves the proactive detection of potential policy violations by specifically analyzing unusual activity patterns and suspicious profile information. In addition, trained moderation staff conduct regular random audits and use warning and stop signs for conspicuous profiles to inform users of possible risks.

5. Reporting and Cooperation Processes

Ride Out maintains an internal reporting office that is available around the clock for tips and logs all reports anonymously. Confirmed cases are immediately forwarded to the competent law enforcement authorities and the youth welfare office. Furthermore, we cooperate with international reporting centers such as the NCMEC. Affected users will be informed about measures taken, and their accounts may be blocked if applicable.

6. Evaluation and Updating

Semi-annual internal reviews take place, in which technical filters and processes are adjusted. Ongoing community feedback is also incorporated into the continuous optimization of our measures.

7. Contact

For questions and tips regarding child protection, our team is available around the clock at support@ride-out.de.
